Grant Woods Hired To Review Mesa Facility Where 90
PHOENIX Former Arizona Attorney General Grant Woods has been hired to conduct an organizational review of the Mesa long-term care facility where a 90-year-old resident died last month after being left in a transport van.
Canyon Winds Assisted Living and Memory Care hired the high-profile attorney to lead a comprehensive independent review of all aspects of operations, the facility said in a press release Tuesday.
On July 22, Lawrence Bearse was found dead in the van in the parking lot of the facility near McDowell Road and the Loop 202 Red Mountain Freeway.
Bearses granddaughter told ABC15 that Bearse had advanced Alzheimers disease, was wheelchair-bound and couldnt communicate. She also said the family believes hed been in the vehicle for at least 20 hours before a facility worker realized he was there.
Woods said in the release that his goal is to make sure we understand exactly what happened in this incident, and to ensure that every resident who calls Canyon Winds home is as safe as possible, as healthy as possible, and has full confidence in his or her caregivers 24-7-365.
The Mesa Police Department and Arizona Department of Health Services are investigating the incident. Canyon Winds said it is fully cooperating with the investigations.
Canyon Winds said Woods and his team will have access to all aspects of the facilitys operations, protocols and business practices.

A grieving family looks for answers after a 90-year-old man died after apparently being left in a van outside a Mesa care home
MESA, AZ — A resident at the Canyon Winds Assisted Living & Memory Care facility was found dead in a transport van Thursday afternoon. He has been identified by family members as 90-year-old Lawrence Bearse.
According to Mesa police, a patrol officer was flagged down by a worker at the retirement facility near the Loop 202 Red Mountain freeway and McDowell Road in east Mesa. The worker told the officer they found a resident of the facility who had been left in one of their transport vans. The officer went into the van and found Bearse dead. Mesa Fire and Medical crews arrived and confirmed the death.

It’s unclear how long Bearse was in the van or the circumstances that may have led to his death. But his family believes he was left outside in the transport van for 20 hours before he was found dead.
Mesa police say the investigation is in its beginning stages and that detectives are interviewing workers at the facility.
This is horrific, and it shouldnt have happened, said Kylie Bearse, Lawrences granddaughter. We called him Grandpy and he was the greatest family man you could ever ask for.
She got an unexpected call from her dad Thursday morning. He said Grandpy passed away, and immediately sad, but then he goes It gets worse, Kylie recalled.

Adhs Opens Investigation Into Mesa Care Facility After 90
The Arizona Department of Health Services has launched an investigation into Canyon Winds Assisted Living and Memory Care in Mesa after a 90-year-old resident was found dead in a transport van in the facility’s parking lot.
Lawrence Bearse’s family told 12 News that he was placed in the facility in June of 2020 due to his advanced Alzheimer’s. He was a proud Marine who served in the Korean War.
Kylie Bearse, Lawrence Bearse’s granddaughter, said he was taken by Canyon Winds staff to a doctor’s appointment around 3 p.m. Wednesday. When his wife of 67 years came to visit him around 11 a.m. Thursday, staff did not know where he was.
He was located deceased in the van after a search.
Its a lot of anger. The sadness will come but right now. Its just, how could this happen? Kylie said.
According to an ADHS spokesperson, Canyon Winds self-reported the deadly incident which triggered the state investigation. ADHS staff were on-site at the facility near McDowell and Power roads on Friday.

According to ADHS data, the state last inspected the Mesa facility in May and cited Canyon Winds twice. One citation was for failing to administer some residents the proper medication. A second citation was issued for failing to ensure fire extinguishers were up to date.
“Unfortunately I have no comment at this time,” said a woman who answered the phone at Canyon Winds on Friday.

How Could This Possibly Happen
The questions are obvious and there are a lot of them.
Like how does a guy who cannot take care of himself get left in a van? How does he go missing in an upscale facility that is being paid to care for him?
How does he miss dinner and no one notices?
How does he miss his medication? And multiple night checks? And breakfast?
Who changes him at night and in the morning gets him ready for the day?
How is it that a 90-year-old man in need of constant care can go missing for 20 hours and it takes his wife dropping by the next day for anyone to even notice that he is gone?
This isnt an isolated error by a careless or distracted worker. Its a catastrophic, systemic, fundamental failure.
Leibowitz cant answer the questions, citing federal and state privacy laws. But he says Canyon Winds has hired attorney Grant Woods to do a comprehensive team review of what went and how Canyon Winds can ensure it never happens again.
Every resident at Canyon Winds must be safe, well cared for and treated with the utmost respect, 24-7-365, Leibowitz said. There can be no more mistakes.
But even one mistake is too many when the cost is this high.
‘we Don’t Know Why They’re Stonewalling’
We dont know why theyre stonewalling us and then telling the public that theyre being transparent, Kylie told me. They have not produced even one single document we requested.
David Leibowitz, who is handing communications for Canyon Woods, says staffers are devastated and the assisted living facility is doing everything we can to treat the Bearse family as we would wish to be treated in such an awful situation.
In matters where civil litigation seems likely, most companies would refuse to turn over any information at all to a family and their lawyers, Leibowitz said, via e-mail. We have not done that. Instead, when family members came to Canyon Winds the day after this incident, we turned over Mr. Bearses complete file every single document pertaining to his medical care and his 14 months at Canyon Winds. Their lawyers had it with them, marked up, when we met subsequently to answer their questions.
Of which there are many questions that I am guessing keep the Bearse family awake at night, along with anyone who has someone in assisted living or memory care.
Bearse had advanced Alzheimers and had been living in Canyon Winds since June 2020.
Kylie Bearse said her grandmother, Barbara, visited regularly. She was there on July 21 and saw her husband of 67 years off around 3 p.m. that day as he left in the facilitys transport van to go to a doctors appointment.

It is feared that the 90-year-old, identified by the family as Lawrence Bearse, may have been in the van outside the Canyon Winds Assisted Living & Memory Care facility in Mesa for as long as 20 hours after accidentally being left there by a staff member.
A Mesa Police officer found the body of Lawrence Bearse inside the van after being flagged down by a worker at the retirement facility on Thursday, July 22.
“This is horrific, and it shouldn’t have happened,” his granddaughter, Kylie Bearse, told KPHO/KYVK. “The amount of anger that you feel when you hear that is justMy family, we don’t know how to explain it. We’re just all in shock.”
Lawrence Bearse had been living at the Canyon Winds Assisted Living & Memory Care facility since June 2020. Concerns were raised after his wife of 67 years went to visit him on the Wednesday after he was taken in the van for a doctor’s appointment.
“They didn’t realize he was missing until my grandma showed up to visit him this morning,” Kylie Bearse said, via CBS 5.
Mesa Police and the Arizona Department of Health Services have both launched an investigation into the incident.
An ADHS spokesperson told 12 News that Canyon Winds had reported the death of the 90-year old being found dead to the department.

MESA, AZ – A Mesa woman who had placed her husband at Canyon Winds Assisted Living and Memory Care says she was heartbroken after learning a resident of the facility was found dead in a transport van this past week. Pam Wagner claims the facility failed to keep track of her loved one, too. “I thought that could have been Bob,” says Wanger. “He could have been out in a car in 110 degrees and they wouldn’t have found him,” says Wagner.
Wagner made the difficult decision to place her husband at Canyon Winds in December, 2020 because the 73-year-old would wander at night and was no longer safe at home. “I’d find the shower was on all night or I’d find him in the kitchen,” says Wanger. “As much as I locked up knives and medications, he’d still manage to find something.”
Wagner says Bob was at the facility for six days when she got a call from staff saying he had escaped for the third time. “They never told me about the first time or the second time,” says Wanger. “They finally found him in somebody’s car.” Wagner says she removed Bob from Canyon Winds and he passed away a few weeks later.
