Colorado Medicaid Hcbs Waiver Program

Colorado has a Medicaid Home and Community-Based Services waiver program, which is designed to provide assistance to eligible individuals so that they can remain living independently at home and in assisted living facilities instead of in nursing homes. Assistance offered under this program, called the Elderly, Blind, and Disabled Waiver, may include adult day care, personal care assistance, alternative care facilities, in-home support services, and personal emergency response systems.

Generally, the EBD Waiver program offers services that accompany or add to services applicants receive through Health First Colorado, other government programs, and family- and community-based supports. To qualify for the EBD Waiver, applicants must meet certain financial and program criteria, and they must be willing to receive services in the home or community. The EBD Waiver program has rules and requirements in addition to those of Health First Colorado, and the program may have waitlists.

Colorado Old Age Pension Program

The Colorado Old Age Pension program helps to financially assist and maintain a minimum monthly income for low-income residents 60 years or older. This program offers to help make up the difference between what the resident brings in and what the state determines to be a minimum income for that year.

Who is Eligible?

To qualify for the OAP Program an applicant must meet the following criteria:

  • Must be between 60-64 years old
  • Must be a Colorado resident
  • Must be a U.S. citizen or legal immigrant
  • Must have countable resources less than $2,000 or less than $3,000
  • Must not have a monthly income that exceeds $788
  • Must not qualify for Health First Colorado

Assisted Living Service Plan Requirements

Assisted living facilities in Colorado are required to have a written care plan for each resident that is reviewed at least annually. These plans must be based on a complete assessment that evaluates health, behavioral, social and physical needs and strengths. Care plans should also outline whether a senior:

  • self-administers medication or needs help from staff
  • needs assistance with any activities of daily living
  • has activity restrictions ordered by their doctor
  • has any dietary needs or restrictions

Assisted Living Admission Requirements

Assisted living facilities in Colorado cannot admit residents who are consistently and completely incontinent unless the resident or the facilitys staff can ensure that it doesnt become a health hazard for other residents. Facilities cannot admit residents who are entirely bedridden with limited potential for improvement, require 24-hour skilled nursing care, have an acute substance abuse problem, have a communicable disease or are in need of restraints.

If a current resident becomes bedridden, they may continue living in the community if there are enough staff members trained in meeting the needs of bedridden residents, a licensed hospice of home health service ensures that the resident’s physical, social and emotional needs are met, and a physician outlines the care services the resident needs.

Medicaid Income Rules In Colorado

In Colorado, a single person can have a monthly income up to only $2,313 in 2019 and qualify for Medicaid-paid nursing home care. The Medicaid income limit for a married couple, with both spouses applying, is $4,626 per month in 2019. These LTC income limits may be higher than the income limit for those applying for other health care benefits from Medicaid.

For purposes of determining Medicaid eligibility, any income an applicant receives, from any source, is considered. However, when only one spouse of a married couple applies for Medicaid, the income of the non-applicant spouse is not counted, so that he or she has enough funds on which to live. Additionally, the non-applicant spouse is entitled to a minimum monthly needs allowance, which may range from $2,113.75 to $3,160.50 .

If you qualify for Medicaid and live in a nursing home, you will be expected to spend almost all income on your care. Colorado allows nursing home residents receiving Medicaid to keep only $84.41 per month as a personal needs allowance.

    Colorado Long Term Care

    Colorado is an income cap state for 2021, meaning that in order to be eligible for Medicaid long term care benefits there is a hard income limit. Non income cap states allow applicants to spend down money for their care, whereas income cap states require the amount to be no higher than their limit at time of application.

    Unlike traditional Medicaid sponsored long term care, Colorado has what they call a long term care partnership. The partnership melds together private insurance and state funds. This is a beneficial system for recipients who do not wish to deplete all of their assets paying for care. It is designed to reward residents who have planned ahead for their long term care needs. Colorado allows insurance companies to sell LTC partnership policies and guarantees that for every dollar paid out by an LTC partnership plan, a dollar of the recipients personal assets can be protected. Protected assets are ignored when reviewing an applicants financial eligibility and during estate recovery after a long term care recipients death. LTC partnership policy holders who apply for Medicaid are able to keep assets above the $2,000 Medicaid asset maximum.

    Medicaid is a federal program, administered by the states, that provides health care for low-income people, including seniors.

    To qualify for Medicaid, a seniors income and assets have to fall below certain levels, known as the means test.

    Many assisted living facilities, memory care facilities, and nursing homes throughout the Denver metro area accept Medicaid.

    Before a senior can qualify for Medicaid, he or she needs to meet with a case worker who will assess the financial situation. If there are assets, the senior will have to enter the facility as a private pay patient or resident and spend down the assets until he or she qualifies for Medicaid.
