Assisted Living Service Plans
Within 14 days of admission to a Texas ALF, service providers must meet with new residents to fill out a service plan, sometimes called a needs assessment. ALF administrators will interview potential residents to determine their needs and desires in order to make sure their experience at the facility will be sufficient to their needs.
Administrators must also use this meeting to disclose regulations and practices concerning things like activities of daily living patterns, psychosocial issues, and behavioral symptoms, as well as residents rights and community rules.
Any residents who receive behavioral care must have goals and strategies included in their service plan, and the plan must be confirmed by a physician or behavioral healthcare provider. If the plan involves recurrent medication administration or other skilled nursing services, a nurse or medical practitioner must review and confirm the provisions.
Assisted Living Medicaid Policy
Unlike some other states, Texas does not provide Medicaid reimbursement to ALF residents unless they have a very low income or are Home- and Community-Based Services waiver recipients. Only nursing-home eligible residents can receive waiver services, and these individuals must reside in Type B assisted living communities. Waiver services are provided by managed care organizations, and all services they provide, such as personal care and medication assistance, can be reimbursed through Medicaid.
Assisted Living Admission Requirements
An assisted living facility cannot accommodate residents whose medical needs exceed the capabilities of staff unless a resident is covered by a licensed home health agency. Home health agencies can be hired by residents with greater care needs, although there are limitations on residency in an ALF for more fully disabled individuals. The state of Texas determines the extent of care available at ALFs by designating two levels of assistance, Type A and Type B, with Type A residents not requiring the added assistance of a home health agency.
Residents cannot be admitted to an ALF if they are permanently bedridden, or if their medical needs cannot be met by the facility or by a contracting home health agency.

What Is An Assisted Living Facility
Assisted living facilities provide individualized health and personal care assistance in a homelike setting with an emphasis on personal dignity, autonomy, independence and privacy. Facilities can be large apartment-like settings or private residences. Services include meals, bathing, dressing, toileting and administering or supervising medication.
Texas Health and Human Services licenses assisted living facilities based on residents’ physical and mental ability to evacuate the facility in an emergency and whether nighttime attendance is necessary.
- A Type A facility cares for residents who do not require routine attendance during sleeping hours and are capable of following directions in an emergency.
- A Type B facility is for residents who require staff assistance to evacuate, are not capable of following directions in an emergency and require nighttime attendance.

Assisted living facilities are regulated under Health and Safety Code, Chapter 247 and Texas Administrative Code, Title 26, Part I, Chapter 553.

Assisted Living Facility Requirements
In a single assisted living unit, no more than four residents may live in the space, and in any ALF community, no more than 50% of all units can be inhabited by more than two residents.
Space requirements:
- Usable floor space in Type A units must be at least 80 square feet for a single room, and no less than 60 feet per bed for multi-residential units.
- Usable floor space in Type B units must be at least 100 square feet for a single room, and no less than 80 feet per bed for multi-residential units.
Bathroom requirements:
- All bedrooms must be accompanied by gender-specific restrooms.
- Restrooms may be communal, private, or connecting between bedrooms.
- Each sleeping floor of an assisted living unit must have at least one water closet, lavatory, and bathing area.
- One water closet and one lavatory must be provided per every six residents, and at least one bathing area must be provided per every ten residents.
Fire safety and emergency evacuation standards are determined by the National Fire Protection Associations Life Safety Code. Among the Codes specifications are rules for the provision of automatic sprinkler systems and smoke alarms, along with spatial navigability and maximum occupancy regulations.

How Are These Facilities Regulated And Where Are The Opportunities To Hold Them Accountable
Its a little different if youre talking about an assisted-living facility or a nursing home. Assisted-living facilities are not federally regulated, so this leaves a lot of transparency and data issues. We dont have any federal oversight or data about violations that are happening in assisted-living facilities, but there are state rules that facilities are required to adhere to for their licensure requirements.
The state regulatory body is the Texas Health and Human Services long-term care regulation department. It does biannual surveys of assisted-living facilities and also go in for complaints.
Nursing homes are federally regulated and state-regulated. The same long-term care regulation program monitors the nursing facilities annually and also for complaints. It monitors for violations of both state and federal regulations they kind of act on behalf of the federal government when going in and looking for violations.

Infection control has really been the focus, and this is at the direction of CMS the Centers for Medicare & Medicaid Services. Texas Nursing Home Hit With $120k Fine After Multiple Safety Violations

River City Care Center in San Antonio, the region’s designated COVID-19 isolation facility since April, is facing a state-issued fine of at least $120,000 after an investigation from earlier this summer concluded unsafe conditions put its 50 residents at risk, reports KSAT.
In July, temperatures inside residents’ rooms reached over 80 degrees after the facility’s HVAC system failed, records shared with KSAT from the Texas Health and Human Services Commission showed. The facility installed a new system shortly after, but the intermittent heat caused heat-induced convulsions in a resident who later died at a hospital.
HHSC records showed the facility is facing a lawsuit filed this month on behalf of Richard Isenhour, a former resident who spent about two weeks at the facility in June after testing positive for COVID-19 at a separate care center. The suit claims River City delayed an X-ray order that later showed Mr. Isenhour was suffering from pneumonia or a collapsed lung. He was taken to a hospital July 7 and later died in hospice.
The facility doesn’t plan on appealing the fine or disputing the violations, and has voluntarily reduced the number of residents it cares for, reports KSAT.
“Issues identified by inspectors were rectified immediately and we are confident in the professionalism and level of care our staff is providing to residents and patients,” River City’s parent company said in a statement to KSAT.

Found On The Pavement
On paper, Hilltop Rehabilitation, a sprawling ranch-style nursing home in Weatherford, Texas, seems like a place where little ever goes wrong. On Medicares rating website, the facility has won the highest scores on its health inspections for four years straight, not incurring a single serious infraction.
Whats missing from that picture, though, is what happened to Alan Harts mother, Laverne.
In 2014, he placed the 87-year-old retired childrens book author, who had dementia, at Hilltop because he was having trouble caring for her on his own.
Mr. Hart said it broke his heart to move her, but he thought she would be in good hands at the five-star nursing home, which planned to keep her on a supervised, locked floor.
In August 2015, Ms. Hart was left alone and tumbled from her wheelchair, injuring her shoulder, according to court documents and her son.
Then, shortly before Christmas, Ms. Hart was alone again. She wheeled herself out of unlocked doors to the facilitys parking lot, where she fell, smashing her face on the pavement. It was just above freezing outside, and she was wearing only a thin nightgown. More than 30 minutes had passed before she was found on the ground, her hair matted with blood and her nose broken.
Mr. Hart, a police officer, was at work when he got the call. As he sped to Hilltop, he prepared for the worst. I thought she was dead for sure, he said. They didnt supervise her at all.
