Designation Of Units For Assisted Living
If all units within a facility meet the physical requirements of assisted living regulations, the Residence is not required to designate the specific units for certification.
If units are not being used as assisted living units, and all units do not meet the physical requirements, the residence must designate the specific assisted living units for certification.
However, it is important that the Residence not open additional units to residents above the maximum approved number without completing the certification process in 651 CMR 12.4.
Any residence operating assisted living units without certification is subject to a civil penalty of up to $500 per unit/per day, plus additional monetary penalties for referring residents to uncertified units.
Medical Qualifications For Assisted Living
You must qualify medically for Medicaid/a waiver program to pay for assisted living services in any form. Often , you must meet what’s called a nursing home level of care. Some residential facilities offer a variety of options, including independent living, and clients can then move to other alternatives as they need more care.

If your loved one has long term care insurance and if their policy meets certain requirements, it can be used to hire family members as caregivers. Unfortunately, this option is only relevant to a few California residents because most long term care insurance policies are too restrictive. Otherwise, the facility is terminated from the Medicare and Medicaid programs and the residents moved elsewhere.
- Immediate jeopardy means that there’s a reasonable expectation that residents would die or become seriously injured or impaired if adverse circumstances persist.8
- Nursing homes can still receive Medicare and Medicaid funding for as long as six months after an immediate jeopardy finding if it’s in the best interest of residents to stay put . The facility must repay funds received during this period if it doesn’t correct its deficiencies during an approved timetable.
- If a survey reveals deficiencies but they’re not immediate jeopardy, the nursing home has up to six months to undertake corrective action.
- Civil money penalties can be imposed, with the range for immediate jeopardy being $6,525 to $21,393 per deficiency. Penalties range from $107 to $6,417 for deficiencies that caused harm or had the potential to cause more than minimal harm.
- Part of these CMP funds go back to the states to enhance nursing home care.
- Nursing homes found persistently deficient on three standard surveys in a row are subject to state monitoring and denial of Medicare and Medicaid payments.

Nursing Home Reform Act Of 1987
In 1987, the U.S. Congress passed the Nursing Home Reform Act following a lengthy study revealing that nursing center residents had been abused, neglected, mistreated, and provided inadequate care.
The Law enacted sweeping reforms, rules, and requirements under the Omnibus Budget Reconciliation Act of 1987, ensuring skilled nursing residents could receive the best care while maintaining or achieving the highest practicable physical, psychosocial, and mental well-being.
Additionally, the Act established a Residents Bill of Rights where Medicare pays for most of the residents care. The Law also changed the survey, licensing, and certification process conducted by Medicare at all licensed facilities.
The Law states that at least once every fifteen months, the nursing facility will undergo scheduled surveys, unannounced investigations, and resident interviews at irregular intervals to identify any citation or violation of federal and state rules and regulations.
